Terms of Service — Simply Retainers

1. Agreement to Terms

By accessing or using Simply Retainers (“we”, “us”, “our”) services, including purchasing products from simplyretainers.com, you agree to be bound by these Terms of Service and all related policies, including our:

  • Refund & Cancellation Policy
  • Fit Guarantee Policy
  • Privacy Policy

If you do not agree, do not use our services.

2. Nature of Our Products (Disclaimer)

Simply Retainers provides custom-made dental products based on impressions submitted by the customer.

We are not dentists or medical professionals, and we do not provide dental or medical advice. Use of our services does not create a dentist-patient relationship.

By placing an order, you acknowledge and agree:

  • You take your impressions at your own risk
  • Fit and results depend on the accuracy of your impressions
  • Improper impressions may result in poor fit or discomfort

Simply Retainers is not responsible for any injury, damage, or issues that may occur:

  • During the impression-taking process
  • From improper use of products
  • From wearing or using retainers

Our products are not a substitute for professional dental care. If you have dental concerns, you should consult a licensed dentist.

By purchasing, you agree that you are solely responsible for your impressions and use of the product.

3. Customer Responsibilities

You agree to:

  • Provide accurate and complete information when placing an order
  • Follow all instructions for taking dental impressions
  • Submit clear impression photos for approval before returning them
  • Respond to support requests in a timely manner
  • Use products only as directed

Important

  • Impression approval is required prior to returning impressions
  • Failure to obtain approval may result in rejection, delays, additional costs, or denial of remake eligibility
  • Fit and comfort depend on the accuracy of the impressions provided

Simply Retainers is not responsible for issues caused by inaccurate or unapproved impressions.

 

4. Accuracy of Information

You agree to provide accurate and complete information when placing an order.

Simply Retainers is not responsible for issues resulting from:

  • Incorrect or incomplete shipping information
  • Inaccurate contact details
  • Errors provided by the customer

 

5. Fit & Adjustment Process Requirement

If you experience a fit issue, you must follow our Fit Guarantee process.

This includes:

  • Submitting photos or videos showing the issue
  • Following all troubleshooting instructions
  • Returning the product if requested
  • Providing new impressions if required

Required Process

You must allow Simply Retainers to:

  • Evaluate the issue
  • Provide adjustments or guidance
  • Request new impressions
  • Provide a replacement if appropriate

Failure to Comply

Failure to follow this process or provide requested information may result in:

  • Denial of replacement
  • Loss of eligibility under the Fit Guarantee

6. Cancellations

Orders may be canceled within 48 hours of the order date, subject to a $25 cancellation fee to cover materials, processing, and payment fees.

7. Return Policy

Due to the custom and hygienic nature of our products:

  • All sales are final
  • We do not accept returns
  • Returns are not permitted for health and safety reasons

If you experience any issues, please contact us — we will be happy to work with you to resolve them in accordance with our Fit Guarantee Policy.

8. Customer-Provided Molds or Digital Files

If you provide your own molds, impressions, or digital files (including STL files):

  • Simply Retainers will manufacture products based solely on the materials provided
  • You are responsible for the accuracy, quality, and suitability of those materials

Important

  • Fit and results depend entirely on the provided molds or files
  • Simply Retainers does not modify or validate customer-provided data
  • Fit issues resulting from provided molds or files are not considered product defects

No Liability

Simply Retainers is not responsible for:

  • Fit issues arising from customer-provided molds or digital files
  • Errors, distortions, or inaccuracies in submitted data

8. Shipping & Delivery

  • We are not responsible for delays caused by shipping carriers or weather conditions
  • Risk of loss transfers to the customer once the package is handed to the carrier
  • Customers are responsible for providing accurate and complete shipping information

If you would like to upgrade your shipping service, please contact us prior to shipment and we will assist with available options.

9. Communication Consent (Email & SMS)

By placing an order or providing your contact information, you agree to receive communications from Simply Retainers, including:

  • Order updates
  • Shipping notifications
  • Customer support messages

SMS Messaging

If you opt in to SMS messages:

  • Message frequency may vary
  • Message and data rates may apply
  • You may opt out at any time by replying STOP
  • For assistance, reply HELP

 

Mobile opt-in information and consent are never shared with third parties or affiliates for marketing purposes.

Acknowledgment

You acknowledge that:

  • These communications are necessary to provide services and support your order
  • Consent to receive SMS messages is not required to make a purchase

10. Limitation of Liability

To the maximum extent permitted by law:

  • Simply Retainers is not liable for indirect, incidental, or consequential damages
  • We are not responsible for dental outcomes resulting from improper use or inaccurate impressions

Our total liability shall not exceed the amount paid for the product.

11. Disclaimer of Warranties

All products and services are provided “as is” and “as available.”

Simply Retainers makes no guarantees or warranties, express or implied, including but not limited to:

  • Perfect fit or comfort
  • Specific dental or cosmetic outcomes
  • Compatibility with individual dental conditions

Limited Warranty Exception

Any warranties or guarantees are only provided where explicitly stated, including:

  • Our Fit Guarantee Policy
  • Any reorder or replacement programs offered at a set price

All other warranties are expressly disclaimed.

 

12. Governing Law

These Terms shall be governed by the laws of the State of Michigan, without regard to conflict of law principles.

13. Right to Refuse Service

Simply Retainers reserves the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to suspected fraud, misuse, or violation of these Terms.

14. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of updated Terms.
